Hukum Ali Rustam, Tempias Kena Muhyidin

Bila Lembaga Displin UMNO umumkan one of the calon for Timbalan Presiden, Datuk Seri Mohd Ali Rustam dijatuhi hukuman tidak dibenarkan bertanding, immediately timbullah many speculations on this matter.

Towards and heading to Pemilihan Agong UMNO this coming 26th Mac 2009, coffee house talk meramalkan Ali Rustam berpeluang menang sebab dia tersangat popular dikalangan perwakilan all over the country.

That’s why bila keluar keputusan ada tindakan yang dikenakan keatas Ali Rustam, definitely amongst UMNO leaders all level akan mula relate this decision sebagai mahu menyelamatkan kedudukan Muhyidin Yassin…, could it be true?? Why? Adakah kata kata bahawa Ali Rustam was leading all the way membuatkan top UMNO leaders yakin Muhyidin boleh tewas?

As all of us can read in many websites today, dah mula dah cerita mengatakan konspirasi mahu melihat TAC TEAM Najib – Muhyidin, itulah sebabnya tindakan “terpaksa” dikenakan keatas Ali Rustam….

What’s made it look so “weird” apabila, cara hukuman berbeza-beza oleh Lembaga Displin UMNO, ada yang didapati bersalah TAPI boleh bertanding…, can we say Double Standard?

He has been a Minister for many terms, dan dah terbukti dia adalah seorang menteri yang tidak terlibat dengan sebarang isu isu kontrovesi dan can be rated as Performed Minister….

Berbanding dengan Ali Rustam, beliau bukannya Ahli Parlimen, bukan juga seorang Menteri dalam kabinet kerajaan pusat. Seandainya Ali Rustam menang, Najib perlu lantik beliau sebagai Senator, perlu cari Ketua Menteri baru menggantikan beliau di Melaka, aiyseh mennn…, so messy, banyak kerja Najib has to do. Of course I am very sure BN tak akan berani nak suruh Ali Rustam kosongkan kerusi DUN and find one BN MP untuk buat dua pilihanraya kecil di Melaka kalau nak secara rasmi jadikan beliau sebagai Ahli Parlimen, BN tak berani sebab semenjak kebelakangan ini by election selalu memihak kepada Pakatan Pembangkang DAP/PKR/PAS….!! Silap silap hari bulan kedua-dua calon BN tumbang, it will make things worst….

Yang paling nyata ialah apabila Datuk Seri Najib sebagai PM nanti keluar negara, how could Ali Rustam become care taker sedangkan dia tak ada pengalaman sebagai Menteri dalam kabinet kerajaan. The most highest level Ali Rustam pernah duduk dalam kabinet dia pernah menjadi Timbalan Menteri, and that was lebih sepuluh tahun yang lalu.

Kalau pun Lembaga Displin tak kenakan tindakan keatas Ali Rustam belum tentu beliau boleh menang sekiranya perwakilan ada membaca kenyataan dari Datuk Seri Nazri Aziz about Muhyidin Yassin……

Ok now, this is my speculation…., Tan Sri Muhammad Taib boleh buat upset and emerged as the winner in this straight fight with Muhyidin.

Why…? Its simple, those perwakilan yang all this while menyokong Ali Rustam akan buat “protest vote”, they will vote for Mat Taib!
Ini tak mustahil boleh berlaku, so we have an interesting things to watch here in PWTC next week, walaupun I want to see Muhyidin menang, tapi bila ambil kira undi protes dari penyokong penyokong kuat Ali Rustam, please don be surprise if Mat Taib becomes anak Selangor pertama dipilih sebagai Timbalan Presiden UMNO and kemudiannya nanti dilantik sebagai Timbalan Perdana Menteri…

  7. MCA: Malaysia is a secular state

AS MCA Political Education Bureau head, I have reservations over the written reply given by Prime Minister Datuk Seri Abdullah Ahmad Badawi to Member of Parliament for Bukit Gelugor Karpal Singh in the Dewan Rakyat on 12 March 2009 that "Malaysia is a 'negara Islam'."

I welcome the prime minister's statement that Malaysia is not a theocratic state and shall adhere to a parliamentary democratic system as enshrined in the Federal Constitution. But the reference of Malaysia as a "negara Islam" by the prime minister is wholly unnecessary, as the phrase "negara Islam" will only serve to confuse the rakyat and cause unwanted fear.

    Historical documents

The MCA is of the position that Malaysia is nothing but a secular state. This is evidenced from the following historical accounts and the subsequent debates when the Federal Constitution was drafted:

The Alliance Memorandum submitted to the Reid Constitution Commission on 27 Sept 1956 clearly stated that "the religion of Malaya shall be Islam ... and shall not imply that the state is not a secular state."

When the Working Party, comprising the Alliance and the rulers' representatives and the High Commissioner, met on 22 Feb 1957 to review the Reid Commission draft on the possibility of the provision on religion being misinterpreted, the Alliance and Umno chief Tunku Abdul Rahman assured the Working Party that "the whole Constitution was framed on the basis that the Federation would be a secular state."

At the London Constitutional talks in May 1957, the Colonial Office did not object to the inclusion of an official religion after being assured by the Alliance leaders that they "had no intention of creating a Muslim theocracy and that Malaya would be a secular state."

On behalf of the Alliance, (later Tun) Tan Siew Sin told the federal legislature that the inclusion of the official religion "... does not in any way derogate from the principle, which has always been accepted, that Malaya will be a secular state and that there would be complete freedom to practise any other religion."

A year after Independence, on 1 May 1958, then Prime Minister Tunku Abdul Rahman clarified in the Legislative Council that "I would like to make it clear that this country is not an Islamic state as it is generally understood. We merely provide that Islam shall be the official religion of the state."

    Judicial recognition

The above position has received judicial recognition. Former Lord President Tun Mohamed Salleh Abas, in Che Omar bin Che Soh v Public Prosecutor (1988), stated that the term "Islam" in Article 3(1) of the Federal Constitution meant "only such acts as relate to rituals and ceremonies... the law in this country is ... secular law."

The former Lord President Tun Mohamed Suffian Hashim also wrote that Islam was made the official religion primarily for ceremonial purposes, to enable prayers to be offered in the Islamic way on official public occasions, such as the installation or birthday of the Yang di-Pertuan Agong, Independence Day and similar occasions.

Constitution law expert Prof Dr Shad Saleem Faruqi and prominent legal scholar, the late Tan Sri Professor Ahmad Ibrahim, also shared the above observations.

The MCA is of the position that the guiding principles for public administration in our beloved multiracial country shall always adhere to universal values of equality, justice, fairness, transparency, mutual respect, the rule of law, etc., which transcends all religions.

  8. Hi there,
Muhyiddin memang yang paling layak jadi Tim. Presiden dan TPM. But I do agree with your (and many others) theory that the result might turn the other way round disebabkan isu Ali Rustam. Harap2 perwakilan yg dtg tu bukan 'perwakilan kitar semula'.

sebenarnye kita n ramai lagi ahli umno tahu siapa mereka2 ni.kes ali rustam bukan crita baru..betul tak kawan2?
mungkin sis tak tahu pembabitan mereka2 yg baru sekarang di disiplinkan lembaga disiplin UMNO.
cuma yg kami tak paham kenape tindakan/hukuman berbeza2.
sapa yg tak tahu kes rafidah aziz?kes khairy jamaluddin?kes muhammad muhd taib?sume org kuat UMNO tahu siapa mereka2 ni dan macam mana mereka naik menjadi pemimpin2.
jgn terlalu taksub dengan segelintir pemimpin yg pada pandangan mata kasar seorang yg jumud..rupa2 dalang/perosak parti..
